What licence do I need to contract for building work in SA?#

A building work contractor's licence from Consumer and Business Services. It is what lets you contract directly with a customer for building work, and it is issued to the person or company doing the contracting rather than to the person holding the tools.

• The licence covers contracting for the work; doing it competently is a separate question the law also asks.
• Companies and partnerships are licensed in their own right, not through a director's personal licence.
• CBS publishes the classes and the eligibility criteria, and the register is public.

Why do I also need a building work supervisor?#

Because South Australia splits the two. A contractor licence permits the contracting; a building work supervisor's registration covers supervising the work on the ground. A company holding a licence needs a registered supervisor attached to it, and a sole trader commonly holds both.

• Supervisor registration is assessed on qualifications and experience in the relevant trade.
• A licensed company without an attached registered supervisor has a compliance problem, not an administrative one.
• Plumbers, gasfitters and electricians sit under a further set of worker registrations and contractor licences again.

What happens in SA when an invoice is not paid?#

The Building and Construction Industry Security of Payment Act 2009 applies. It gives you a statutory right to progress payments for construction work and an adjudication route faster and cheaper than court, and the Small Business Commission publishes plain guidance on using it.

• A payment claim under the Act has form and timing requirements an ordinary invoice does not satisfy by itself.
• The respondent answers with a payment schedule, and not answering has consequences for them.
• Adjudication produces a determination you can enforce without running a contract case.
